TERMS and CONDITIONS:

PROPERTY OFFERED

The structure being offered for sale is the residential dwelling located at 1231 E Kechi Rd, Towanda, KS (“House”). The sale includes the house structure only and does not include the real estate, land, foundation, utilities, landscaping, driveways, outbuildings, or any other improvements unless specifically stated by the Seller.

AUCTION FORMAT

The House will be sold to the highest qualified bidder, subject to Seller confirmation unless announced otherwise at the time of auction.

PAYMENT TERMS

A non-refundable deposit of $10,000 shall be due immediately upon acceptance of the winning bid.

The balance of the purchase price shall be paid in full within 30 days of the auction date.

Payment shall be made by cash, cashier’s check, wire transfer, or other method approved by the Seller.

AS-IS SALE

The House is sold strictly “AS IS, WHERE IS, WITH ALL FAULTS.”

Seller makes no warranties or representations, express or implied, regarding:

Structural condition
Dimensions
Materials
Suitability for relocation
Compliance with building codes
Presence of hazardous materials
Condition of plumbing, electrical, HVAC, or other systems

Bidders are responsible for conducting their own inspections prior to bidding.

REMOVAL REQUIREMENTS

Purchaser shall be solely responsible for:

Obtaining all permits and approvals required for relocation.
Disconnecting and removing the structure.
Securing transportation permits and escorts.
Compliance with all local, state, and federal regulations.
Repairing any damage caused during removal activities.

REMOVAL DEADLINE

Purchaser shall completely remove the House from the property by December 31, 2026.

If removal is not completed by the deadline, Seller may:

Declare Purchaser in default;
Retain all monies paid as liquidated damages;
Exercise any other remedies available by law.
INDEMNIFICATION

Purchaser agrees to indemnify, defend, and hold harmless Seller, Seller’s agents, auctioneer, and property owners from any claims, losses, damages, injuries, costs, or expenses arising from Purchaser’s activities related to inspection, preparation, removal, transportation, or relocation of the House.

RISK OF LOSS

Risk of loss transfers to Purchaser upon execution of the purchase agreement or receipt of final payment, whichever occurs first. Purchaser shall be responsible for securing and protecting the House thereafter.

DEFAULT

Failure to comply with any auction terms shall constitute default. In the event of default, Seller may retain deposits and pursue any additional legal remedies available.
